ANWIDA Soft – Terms of Use

These Terms of Use (“Terms”) govern the ANWIDA Soft website and its My Account area (the “Service”) and apply to anyone using them. The Service is managed by Andrea Forlani under the ANWIDA Soft name; “we” and “us” refer to him in that capacity. The authors and licensors of ANWIDA Soft software (the “Software”) are identified in the End User License Agreement (“EULA”), which is presented and accepted when installing each product.

By creating an account, you expressly agree to these Terms. If you do not agree, you must not create or use an account.

1. Scope

The Software is licensed under the applicable EULA. Restricting, closing, or deleting an account, or changing the Service, does not affect any Software license.

Software licenses available through the website, including free licenses, are acquired through Lemon Squeezy, which acts as authorized Merchant of Record. Lemon Squeezy is the seller and handles payment, invoicing, taxes, refunds, and chargebacks under its own terms. In case of conflict, Lemon Squeezy’s terms prevail for the transaction, and the EULA prevails for the Software license.

2. Account

You must have the legal capacity to accept these Terms. The Service is not intended for children under 16.

You must provide accurate information, keep your login credentials confidential, and promptly tell us about any suspected unauthorized access.

You must not use the Service unlawfully or fraudulently, interfere with its security or operation, or attempt to gain unauthorized access to systems, accounts, or data.

3. Account restriction and closure

We may temporarily restrict access to an account where reasonably necessary to address a security incident, comply with a legal obligation, or stop unlawful or fraudulent activity affecting the Service. Where reasonably possible, we will tell you the reason.

We may close an account after a material or repeated violation of these Terms that is not remedied after notice. We may close it without notice where immediate action is required by law or to prevent serious harm.

You may delete your account at any time from the My Account area. Deletion also ends access to the downloads in the account. We may retain information where we are legally entitled or required to do so.

4. Availability

The Service is provided free of charge, without any guaranteed service level or continuous availability. Interruptions may occur because of maintenance, security measures, technical faults, or events outside our reasonable control. We will take reasonable steps to restore availability.

Non-essential features may be changed or discontinued for legal, security, technical, or operational reasons, with reasonable notice where practicable.

5. Intellectual property

The website, the My Account area, the ANWIDA Soft name and logos, and the website graphics and materials are protected by intellectual property laws. Except where expressly authorized or permitted by law, they may not be copied, reproduced, distributed, resold, or commercially exploited.

6. Third-party services

The Service may link to, or give access to, independent third-party websites and services. Those services are governed by their own terms and policies.

7. Liability

Liability arising from the Service is governed by applicable law.

8. Privacy

The data processed through the website and the My Account area are described in the Privacy Policy and in the Cookie Policy.

The data processed for activation and online validation of the Software are described in the ANWIDA Soft Software Privacy Notice.

9. Changes to these Terms

We may update these Terms where reasonably necessary for legal, security, technical, or operational reasons. We will give registered users reasonable advance notice of material changes that affect them, unless an immediate change is required by law or to address an urgent security risk. Changes do not apply retroactively.

If you do not accept a material change, you may close your account before it takes effect.

10. Governing law and jurisdiction

These Terms are governed by the laws of Italy, excluding its conflict-of-law rules. If you act as a consumer, this choice of law does not deprive you of any mandatory protection that would otherwise apply. The competent courts are determined by applicable law.
